Consumer Health Data Privacy Notice - Washington Residents

This consumer health data privacy notice (the "Consumer Health Data Privacy Notice" or the "Notice") supplements our Privacy Policy and is designed to help you understand how Metadoc.AI LLC's ("Company," "we," "our", or "us") collects, uses, and shares your information that may be considered Consumer Health Data (as defined below) under the MHMDA and to help you understand and exercise your privacy rights.

This Consumer Health Data Privacy applies solely to personal information defined as "consumer health data" subject to the Washington My Health My Data Act ("MHMDA"). Consumer Health Data includes certain personal information of 1) residents of the State of Washington; and/or 2) individuals whose consumer health information is collected in the State of Washington (collectively "you" or "consumers").

This Consumer Health Data Privacy Notice applies to Consumer Health Data that may be processed by us via our websites, web and mobile applications, and other online services, including but not limited to our website (https://www.metadoc.ai/) and our Cairo Health mobile and web application ("Cairo Health") and all content, features, and services made available therein by Company (collectively altogether, the "Services").

By registering for, downloading, accessing or using any part of the Services you accept and agree to this Consumer Health Data Privacy Notice, whether or not you are a registered user or have an account. You should not use the Services if you don't agree with this Consumer Health Data Privacy Notice or any other agreement that governs your use of the Services.

Capitalized terms that are not defined in this Consumer Health Data Privacy Notice have the meaning given to them in our Terms of Service at https://www.metadoc.ai/terms-of-service/ and our Privacy Notice https://www.metadoc.ai/privacy-policy/.

1. What is "Consumer Health Data"?

"Consumer Health Data," as defined by the MHMDA, means personally identifiable information that is linked or reasonably linkable to you and that identifies your past, present, or future physical or mental health status or that is used to identify your health status as defined by the MHMDA. Consumer Health Data can include:

  • Individual health conditions, treatment, diseases, or diagnosis.
  • Social, psychological, behavioral, and medical interventions.
  • Health-related surgeries or procedures.
  • Use or purchase of prescribed medications.
  • Gender-affirming care information.
  • Reproductive or sexual health information.
  • Biometric data.
  • Genetic data.
  • Precise location information that could reasonably indicate a consumer's attempt to acquire or receive health services or supplies.
  • Data that identifies a consumer seeking health care services.

2. What Consumer Health Data do we Collect?

As described in our Privacy Policy, the Consumer Health Data we collect depends on how you interact with our websites and services. Because Consumer Health Data is broadly defined, many of the categories of data we collect could also be considered Consumer Health Data. For example, Consumer Health Data may include:

  • Information about your health-related conditions, symptoms, status, diagnoses, testing, or treatments (including surgeries, procedures, medications, or other interventions). For example, we may collect such information through surveys or other communication with you for research studies and improving product accessibility.
  • Measurements of bodily functions, vital signs, or characteristics, including photographs, which may also be considered biometric information under the MHMDA.
  • Precise location information that could reasonably indicate your attempt to acquire or receive health services or supplies. For example, if you use Bing maps to get directions to a health care provider, we may collect GPS, cell tower, and Wi-Fi hotspot location data that could reveal health-related information.
  • Information that could identify your attempt to seek health care services or information, including services that allow you to assess, measure, improve, or learn about your or another person's health. For example, we collect your Bing search queries, which may include queries concerning nutrition, wellness, fitness, medical conditions, or other health-related topics.
  • Other information that may be used to infer or derive data related to the above or other health information.

3. What Sources do we Collect Consumer Health Data from?

As described in the "Information We Collect" section of our Privacy Policy, we collect personal information (which may include Consumer Health Data) directly from you, from your interactions with our products and services, from third parties, and from publicly available sources. We collect this information in order to provide you with the Services, as described in the Terms of Service as well as for the purposes described in the "How do we use Consumer Health Data" section below.

4. How do we use Consumer Health Data?

We may use Consumer Health Data to provide the Services, for our administrative purposes (including but not limited to improving, upgrading, enhancing, supporting and administering the Services, security, pursuing our legitimate interests, enforcing our agreements, and complying with legal obligations), and to analyze our customer base, products and services, and trends and traffic and to provide you with non-targeted advertisements. We may also use your Consumer Health Data otherwise with your consent or in accordance with applicable law (such as the creation of de-identified information).

De-identified Information

De-identified information is information that has had the identifiers removed so that it cannot be reasonably linked to a particular individual. This includes removing names, addresses, phone numbers, e-mail addresses, payment card information, and other identifiers that might reasonably link the information to a particular individual.

We do not attempt to re-identify the information in any fashion. Further, we do not permit the recipients of the de-identified information to re-identify the information in any fashion.

5. Who do we Share Consumer Health Data with?

We may share each of the categories of Consumer Health Data described above for the purposes described in the "How We Share Your Personal Information" section of our Privacy Notice. In particular, we may share personal data, including Consumer Health Data, with your consent or as reasonably necessary to complete any transaction or provide any product you have requested or authorized, as described above.

Third Parties With Whom We Share Consumer Health Data

As necessary for the purposes described above, we share Consumer Health Data with the following categories of third parties:

  • Service providers. Vendors or agents working on our behalf may access Consumer Health Data for the purposes described above. For example, payment processors, shipping carriers, and IT and cybersecurity service providers.
  • Business partners. We may share Consumer Health Data with other companies. For example, where you use our services to interact with another company.
  • Financial institutions & payment processors. When you make a purchase or enter into a financial transaction, we will disclose payment and transactional data to banks and other entities as necessary for payment processing, fraud prevention, credit risk reduction, analytics, or other related financial services.
  • Parties to a corporate transaction. If Metadoc and its affiliates undergo a merger, acquisition, or sale of assets, Consumer Health Data may be transferred to the new entity as part of the business transition.
  • Affiliates. We enable access to data across our subsidiaries, affiliates, and related companies, for example, where we share common data systems or where access helps us to provide our services and operate our business.
  • Law Enforcement and Government Agencies. We may disclose Consumer Health Data if required by law, if necessary to comply with a legal request (e.g., a subpoena or court order), or to protect our rights, property, or customer safety.
  • Other users and individuals. If you use our services to interact with other users of the service or other recipients of communications, we will share data, including Consumer Health Data, as directed by you and your interactions.
  • The public. You may select options available through our services to publicly display and disclose certain information, such as your profile, demographic data, content and files, or geolocation data, which may include Consumer Health Data.

6. Your Privacy Rights

If the MHMDA is applicable to your personal information, you may submit a request to know, access, correct, or delete the Consumer Health Data we have collected about you. You may also submit a request to withdraw your consent for collecting and/or sharing of your Consumer Health Data and have us cease collecting and/or sharing such information. If you would like to exercise your rights, please contact us as set forth in "Contact Us" below. We will process such requests in accordance with applicable laws. You have the right to appeal a decision we make relating to requests to exercise your rights under the MHMDA. If your request to exercise a right is denied, you may appeal that decision by contacting our privacy support team via the above contact information. If your appeal is unsuccessful, you can raise a concern or lodge a complaint with the Washington State Attorney General at www.atg.wa.gov/file-complaint.

7. Changes to our Consumer Health Data Privacy Notice

We may revise this Consumer Health Data Privacy Notice from time to time in our sole discretion. If there are any material changes to this Consumer Health Data Privacy Notice, we will notify you by a notice on our website and in this Notice. You understand and agree that you will be deemed to have accepted the updated Consumer Health Data Privacy Notice if you continue to use our Services after the new Consumer Health Data Privacy Notice takes effect. We encourage you to periodically review this page for the latest information on our privacy practices.
